Terms of Service

These Terms of Service govern access to and use of xmailCloud, including hosted mailboxes, the web application, administrative tooling, support services, and any related AI-assisted features.

Acceptance of terms

By creating an account, accessing the platform, or using any xmailCloud service, you agree to be bound by these Terms of Service and any policies referenced within them.

If you are accepting these terms on behalf of a company, organization, or client, you represent that you have authority to bind that entity to these terms.

Services covered

xmailCloud provides business email hosting, mailbox administration, webmail access, account management, support workflows, and optional AI-assisted productivity features.

Features may evolve over time. We may modify, improve, replace, or discontinue parts of the service so long as we do not materially reduce core service obligations already paid for without reasonable notice.

Accounts and customer responsibilities

You are responsible for maintaining the confidentiality of login credentials, admin access, API keys, mailbox passwords, and any systems connected to your workspace.

You must ensure that information provided during signup, billing, domain setup, and support requests is accurate and kept up to date.

  • Keep credentials secure and rotate them when compromise is suspected.
  • Use the service only for lawful business or personal communication.
  • Do not use the service to send spam, malware, phishing, or abusive content.
  • Do not attempt to bypass quotas, security controls, or access restrictions.

Billing and payments

Paid plans are billed according to the pricing, billing period, and plan terms presented at signup or in an applicable order form. Charges are due in advance unless otherwise agreed in writing.

If a payment fails or an invoice remains unpaid, we may suspend or limit access after a reasonable notice period, except where immediate action is required to prevent abuse, fraud, or financial loss.

  • Subscriptions renew automatically unless canceled before the renewal date.
  • Taxes, duties, and regulatory fees are your responsibility unless expressly stated otherwise.
  • Custom enterprise pricing, migrations, or consulting may be governed by separate commercial terms.

Customer content and usage rights

You retain ownership of your content, including emails, attachments, contacts, domain settings, and other materials submitted to the platform.

You grant xmailCloud the limited rights necessary to host, process, transmit, secure, back up, and display that content solely for the purpose of delivering the service.

AI-assisted features

AI-assisted tools may help summarize messages, rewrite drafts, generate signatures, or support workflow suggestions. These features are provided to assist users and should be reviewed before use in customer-facing or regulated communications.

You remain responsible for all final content sent through the platform, including AI-generated drafts, summaries, recommendations, or edits.

Availability and support

We aim to provide reliable service availability, security monitoring, and operational maintenance. However, uninterrupted availability cannot be guaranteed.

Planned maintenance, urgent security actions, abuse mitigation, provider outages, and internet-wide incidents may affect availability from time to time.

Suspension and termination

We may suspend or terminate access if you materially breach these terms, fail to pay for the service, create legal or security risk, or use the service in a way that harms the platform, other users, or third parties.

You may stop using the service at any time. Termination does not remove payment obligations already incurred before the effective termination date.

Disclaimers and limitation of liability

Except as expressly stated, the service is provided on an 'as available' and 'as is' basis. To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, xmailCloud will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data.

Our aggregate liability for claims arising out of or relating to the service will not exceed the amounts paid by you to xmailCloud during the twelve months preceding the event giving rise to the claim.

Changes to these terms

We may update these terms from time to time to reflect legal, operational, or product changes. When we do, we will update the effective date above and provide notice where appropriate.

Your continued use of the service after updated terms become effective constitutes acceptance of the revised terms.
